1. Validity

These general contract conditions (“Conditions”) regulate the sales and supply service of the Products by GOFOR360 Srl (“Gofor360”), with registered and operational headquarters in Monza, Via Val Camonica n. 8, registered with the Milan Chamber of Commerce at no. MB – 2559675 of the Companies Register, tax code no. 10816840960 and VAT number no. 10816840960, owner of the “gofor360” brand, via the site it owns, www.Gofor360.it (the site"). The Conditions also regulate access to and use of the Site.

2. The contract between the User and Gofor360

2.1 The sending of the purchase order ("Order") by the User implies full knowledge and acceptance by the latter of these Conditions.

2.2 There is no commitment between the User and Gofor360 until Gofor360 has sent the User an e-mail (to the address indicated by the User) confirming the correct receipt of the Order, and a summary of all the information on the Product and the Service that were provided to the User immediately before sending the Order itself. There will be no commitment between the User and Gofor360, and therefore no contract can be considered concluded, in the event that obvious and recognizable errors or inaccuracies are committed in the order compilation procedure, due to facts attributable to both the User and Gofor360. , such as - by way of example and not exhaustively - errors or inaccuracies relating to the User's Data (including the address indicated for delivery) or relating to the identification and/or selection of the Products and/or the related quantities and/or or its price.

3. Definitions For the purposes of these Conditions, in addition to terms elsewhere defined, for:

  • “Catalogue” means the set of Products that can be purchased by the User through the Site;

  • “Consumer Code”, means Legislative Decree 6.9.2005, n. 206 et seq. changes;

  • “Conditions”, means these general contract conditions - as also subsequently modified or integrated in accordance with the following article 12 - together with the relevant attachments and other information published on the Site, which are an integral and substantial part thereof, with which it is regulated. the provision of the Service between Gofor360 and the User;

  • “Consumer” means - pursuant to and for the purposes of art. 3 of the Consumer Code - the natural person who acts for purposes unrelated to any entrepreneurial, commercial, artisanal or professional activity carried out;

  • “Data”, means the data communicated by the User and necessary for the execution of the obligations, including fiscal ones, required by the legislation applicable at the time for the provision of the Service;

  • “Service Provider” always means Gofor360;

  • “Payment Manager”, means the body that - duly authorized pursuant to current laws - provides the payment service through the use of the User's credit card or other payment method;

  • “Privacy Policy” means the information provided to the user pursuant to art. 13 of EU Regulation 679/19 (so-called “GDPR”) and Legislative Decree no. 196/2003 (so-called "Privacy Code") as subsequently amended;

  • “Order” means the purchase order submitted by the User relating to one or more Products by clicking - after completing the mandatory fields and choosing the payment method - on the “Purchase” or “Proceed to Purchase” button. ” or similar expressions;

  • “Party” means Gofor360 or the User individually;

  • “Parties” means, collectively, Gofor360 and the User;

  • “Product” means each of the products that can be purchased through the Site, as better specified in the Catalogue, including, for example, food supplements or cosmetic products;

  • “Registration Form”, means the membership form on the Site through which the User enters their Data in order to create an account and use the Service;

  • “Product Sheet” means the set of descriptive information of the Product and its components, as well as the price, availability and deadline for delivery;

  • “Service”, means the service of sale and supply to the User of the Products distributed through the Site, as better specified in the Catalogue, to be understood as an integral and substantial part of these Conditions;

  • “Site”, means the Internet site called “ https://www.gofor360.it ” owned by Gofor360;

  • “User”, means the natural or legal person who, after correct and truthful registration of their Data and, furthermore, the payment of the fee referred to in the following article 6, uses the Service.

4. Object

4.1 These Conditions have as their object the provision of the Service, on a non-exclusive basis, by Gofor360, of the Products, the detailed information of which can be found in the Catalog and possibly in the individual Product Sheets.

4.2 In the event of unavailability of the Product during the processing of the Order, Gofor360 will inform the User via e-mail and consequently update the Order with the elimination of the unavailable Product. The other Products included in the Order (where available) will be shipped according to the times indicated in the Product Sheet except in cases of unavailability of the same as clarified in article 7 below. It is understood that if all the Products included in the Order are not available, Gofor360 will notify the User via e-mail that the Order must be considered cancelled.

6. Fees and Payment Methods

6.1 The available payment methods are: - Credit card; - Paypal; - Cash on delivery (for non-digital products only); - Apple Pay; - Google Pay.

6.2 The prices of the Products are clearly indicated on the Product Sheet, in Euros, and are inclusive of VAT, where applicable. The shipping cost may be added to the price of each Product (to the extent indicated on the Site), the amount of which may vary based on the delivery method requested or the price of the individual Product or the set of Products indicated in the Order. In the event that the Product is not available or becomes unavailable during the processing of the Order, the User will be informed by communication addressed to the e-mail indicated in the Registration Form. After notification of unavailability of the Product, Gofor360 will refund the User the payments received in relation to the unavailable Product without undue delay with an update of the relevant Order; however, where no payments have been made for the price of the unavailable Product, no amount will have to be paid by the User.

7. Delivery of the Products

Gofor360 will deliver the Products indicated in the Order to the address indicated by the User. All delivery times reported on the Site are estimates based exclusively on availability, on the normal processing of the Order and on the delivery times declared by suppliers and carriers: each Product indicates, on the Product Sheet, a standard time of availability. This is the minimum time estimated as necessary to make the Product available for shipment. Naturally, the actual delivery time may differ from the time indicated in the Product Sheet as it will depend on the behavior of the carriers; in fact, the Product Sheet indicates the maximum time within which the Product will be delivered to the User except in exceptional cases of unavailability of the same which will be communicated via email by Gofor360.

8. Security in payments

8.1 On the Site, payments are and will remain protected by an advanced online data defense system. Payment by credit card takes place on a secure server managed by a third-party company, specialized and duly authorized in accordance with the laws in force to carry out this service: therefore, the data relating to the credit card are processed exclusively by the Payment Manager. Gofor360 will therefore not have access to credit card data, but will only manage the User's Data.

8.2 No responsibility can be attributed to Gofor360 for any fraudulent use by third parties of the User's credit card data: in this case the User must immediately contact the Payment Manager and possibly the competent Authorities.

9. Right of withdrawal

9.1 Pursuant to and for the purposes of art. 54 of the Consumer Code, the User acting in the capacity of Consumer, within 14 (fourteen) days of delivery of the Product, will be able to exercise the right of withdrawal, obtaining a full refund of the amounts paid for the purchase of the Product therein including delivery costs incurred. In the event that the User has chosen to have the Products requested in a single Order delivered in multiple shipments or in the case of a Product consisting of multiple lots or pieces to be delivered in multiple shipments, the deadline for exercising the withdrawal will begin with the delivery of the latest Product.

9.2 To exercise the right of withdrawal, the User must forward, within the deadline indicated in the previous paragraph 9.1, the appropriate form published on the Site or a communication of similar content by registered letter with return receipt, or by communication to by e-mail, to the following addresses: GOFOR360 Srl Via Val Camonica, 8, Monza 20900 MB e-mail address info@Gofor360.it

9.3 Within 14 (fourteen) days following the date of notification of withdrawal, the User must send the Product back by registered mail or with tracked shipping to the following address: GOFOR360 Srl Via Val Camonica, 8, Monza 20900 MB fully bearing the relevant Shipping fees. Once the Product has been received, Gofor360 will provide a refund using the payment method chosen by the User at the time of the Order.

10. Legal guarantee of conformity

10.1 Gofor360 reminds the User that all Products are covered by warranty in case of manufacturing faults or defects. In particular, the User acting in the capacity of Consumer has the right to the legal guarantee of conformity pursuant to articles 129, 130 and 132 of the Consumer Code. The User who is not a Consumer (i.e. natural or legal persons who have purchased the Products in the exercise of their entrepreneurial, commercial, artisanal or professional activity, also by requesting an invoice, indicating their VAT number) will have in any case right to the guarantee for defects pursuant to art. 1490 of the Civil Code and following.

10.2 The legal guarantee lasts two years from delivery of the goods and must be asserted by the Consumer within two months of discovery of the defect. The Consumer can assert his rights regarding the legal guarantee by contacting Gofor360 directly at the address:

11. Modification of the Conditions

Gofor360 undertakes to provide the Service in the manner, under the conditions and at the price indicated on the Site. It also reserves the right to modify or integrate these Conditions by publishing them on the Site: changes to the Conditions will be effective from the moment of publication on the Site.

12. User Responsibilities

12.1 The User declares and guarantees: (i) that he or she is an adult (if a natural person); (ii) that the Data provided by the same for the execution of the Service is correct and truthful; (iii) that will update the Data provided to Gofor360 whenever necessary; (iv) to have the power to bind the legal person represented by him (if legal person).

12.2 The User undertakes not to use the Service offered in an illicit or unauthorized manner.

12.3 The User ensures that the information provided in the Registration Form and at the time of the Order is legitimately available and does not violate any rights of third parties.

13. Limitation of Liability

13.1 In any case, Gofor360's liability for failure or delayed provision of the Service resulting from circumstances beyond its control or causes of force majeure including, by way of example and not limited to, natural disasters, adverse conditions is excluded. atmospheric conditions, sabotage, fires, floods, earthquakes, strikes, epidemics, pandemics, the faulty functioning of the Service resulting from the incorrect functioning of telephone lines, electricity lines and global and/or national networks, such as, purely for illustrative and non-exhaustive purposes, faults, overloads, interruptions.

13.2 Without prejudice to what is indicated in the previous article 13.1, the Parties agree and mutually acknowledge that in any and all cases Gofor360's liability cannot exceed the sums paid by the User for the provision of the Service.

13.3 Gofor360 will also not be responsible for distorted use of the Products by the User. The information present in the Product Sheets that the User can consult on the Site must not be interpreted as medical advice and does not intend to, nor can it replace, medical prescriptions. The information contained on this site concerns the ingredients contained in food supplements and Products. Supplements are not intended as a means to treat, prevent, diagnose, or mitigate any disease or abnormal condition.

14. Intellectual property All information, data, news, all reproduced trademarks and/or in any case any type of content transmitted by Gofor360 in execution of the Service are confidential and protected. The User is therefore authorized to use the aforementioned data, information, news and contents, for exclusively personal use, undertaking not to distribute, disseminate, license or transfer said contents by any means, including electronic means, publication, transfer to third parties for any reason. .

15. Prohibition of assignment

15.1 These Conditions and the Service relating to and consequent to them are strictly personal in nature and, therefore, the User does not have the right to assign, in whole or in part, or to transfer these Conditions for any reason to third parties, without the prior and explicit written consent of Gofor360.

15.2 The Parties agree and mutually acknowledge that, if the User requests that the Product be delivered to a third party, the obligations deriving from these Conditions will still bind Gofor360 and the User, pursuant to art. 1411 cc

16. Applicable law, jurisdiction and competent court

16.1 The Service will be governed, in addition to these Conditions, by Italian law and, in particular, with exclusive reference to the User who can qualify as a Consumer, by the rules of Chapter I of Title III of part III of the so-called Consumer Code.

16.2 Any dispute that may arise between the Parties regarding the validity, interpretation or execution of these Conditions will be subject to Italian jurisdiction. Except as provided by the art. 66-bis of the Consumer Code and in any case if the User cannot qualify as a Consumer, the Court of Milan will have exclusive jurisdiction for the resolution of disputes arising between the Parties.

16.3 For the out-of-court resolution of disputes arising in relation to contracts with consumers governed by the provisions of Sections I to IV of Chapter I of Title III of part III of the Consumer Code and inherent to these Conditions, the User may resort to the procedures of mediation pursuant to Legislative Decree no. 28/2010, or may use the ADR bodies through the ODR platform for online dispute resolution, established and managed by the European Commission, and accessible via the following link http://ec.europa.eu/consumers/odr/.

17. Illegitimacy of terms and conditions If for any reason a part of these Conditions is found to be invalid or ineffective, the validity and effectiveness of the remaining terms and conditions will be fully preserved.

18. Processing of personal data

18.1 As better specified in the Privacy Policy to which express reference is made, Gofor360 as data controller guarantees that the Data provided by the User by completing the Registration Form will be processed in compliance with the provisions of the GDPR and the Legislative Decree . Legislative Decree no. 196/2003 (“Privacy Code”) as amended and any other current legislation regarding Privacy.

18.2 Without prejudice to the rights recognized by articles 15 and following of the GDPR, the User's Data will be processed in the manner and for the purposes indicated in the Privacy Policy and for which the User has expressed his/her consent.
